An Act to Amend An Act Respecting Certain Parks and Streets in The City of Fredericton

WHEREAS The City of Fredericton prays that it be enacted as hereinafter set forth;

THEREFORE, His Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as follows:

1 Section 4 of An Act Respecting Certain Parks and Streets in The City of Fredericton, chapter 74 of the Acts of New Brunswick, 1993, is amended

(a) by repealing subsection (2);

(b) in subsection (3) by striking out “paragraph (vii)” and substituting “paragraph (v)”.

2 Schedule A of the Act is amended

(a) by repealing paragraph (v) and substituting the following:

(v) the parcel of land on the northern side of Prospect Street described as follows:

beginning at the intersection of the southeast corner of Lot 50 shown on Plan 5442 – Reg. 1977-06-07, (PID 75002121) with the northerly limits of Prospect Street, said point having New Brunswick Grid Coordinates of E-2486085.943 and N-7438535.365; thence along the northerly limits of Prospect Street on an azimuth of 301 degrees 51 minutes 50 seconds, a distance of 358.053 metres; thence on an azimuth of 31 degrees 50 minutes 50 seconds, a distance of 15.240 metres; thence on an azimuth of 301 degrees 30 minutes 00 seconds, a distance of 21.700 metres, to a point designated as 868 shown on Plan 9952 – Reg. 1990-05-28, having New Brunswick Grid Coordinates of E-2485771.381 and N-7438748.660; thence on an azimuth of 17 degrees 34 minutes 30 seconds, a distance of 334.259 metres, to the southeast corner of Lot 96-160 shown on Plan 201181 – Reg. 1997-10-20; thence on an azimuth of 17 degrees 36 minutes 10 seconds, a distance of 49.913 metres, to the northeast corner of Lot 96-160 shown on Plan 201181 – Reg. 1997-10-20 designated as point 641 having New Brunswick Grid Coordinates of E-2485887.405 and N-7439114.893; thence on an azimuth of 17 degrees 59 minutes 40 seconds, a distance of 60.924 metres; thence on an azimuth of 17 degrees 47 minutes 50 seconds, a distance of 121.923 metres; thence on an azimuth of 17 degrees 48 minutes 40 seconds, a distance of 61.450 metres, to the northeast corner of Parcel B shown on Plan 9930 – Reg. 1990-05-07, designated as point 22, having New Brunswick Grid Coordinates of E-2485962.289 and N-7439347.429; thence on an azimuth of 85 degrees 59 minutes 40 seconds, a distance of 33.985 metres; thence on an azimuth of 15 degrees 21 minutes 50 seconds, a distance of 28.865 metres; thence on an azimuth of 63 degrees 57 minutes 30 seconds, a distance of 60.716 metres; thence on an azimuth of 150 degrees 01 minutes 30 seconds, a distance of 82.479 metres, to the southwest corner of Lot 21 shown on Plan 1238 – Reg. 1966-12-13, said point having New Brunswick Grid Coordinates of E-2486099.598 and N-7439332.844; thence on an azimuth of 60 degrees 37 minutes 30 seconds, a distance of 158.497 metres; thence on an azimuth of 31 degrees 00 minutes 50 seconds, a distance of 30.782 metres; thence on an azimuth of 330 degrees 37 minutes 30 seconds, a distance of 21.669 metres, to the limits of Cameron Court; thence along the limits of Cameron Court, on an azimuth of 45 degrees 54 minutes 40 seconds, a distance of 126.357 metres, to intersect with the west property line of Lot 88-4 shown on Plan 9268 – Reg 1988-06-20, said point having New Brunswick Grid Coordinates of E-2486333.705 and N-7439543.770; thence on an azimuth of 173 degrees 23 minutes 30 seconds, a distance of 67.465 metres; thence on an azimuth of 109 degrees 41 minutes 40 seconds, a distance of 54.730 metres, to the southeast corner of Lands for Public Purposes, shown on Plan 9268 – Reg. 1988-06-20, designated as point 153 having New Brunswick Grid Coordinates of E-2486392.997 and N-7439458.309; thence on an azimuth of 210 degrees 34 minutes 10 seconds, a distance of 897.854 metres; thence on an azimuth of 100 degrees 41 minutes 30 seconds, a distance of 181.184 metres, to the northwest corner of Lot 54 shown on Plan 5442 – Reg. 1977-06-07, designated as point 36, having New Brunswick Grid Coordinates of E-2486114.404 and N-7438651.635; thence on an azimuth of 214 degrees 55 minutes 10 seconds, a distance of 32.184 metres; thence on an azimuth of 176 degrees 37 minutes 20 seconds, a distance of 67.166 metres; thence on an azimuth of 211 degrees 30 minutes 20 seconds, a distance of 26.779 metres, back to the place of beginning. The above-described parcel of land, having an area of 22.20 hectares, being and meant to be a portion of lands conveyed to The City of Fredericton in Deed 139659 Book 364 Page 609 Reg. 1962-12-18;

(b) by repealing paragraph (vii).
